Terms & Conditions

These terms apply when you create an account, list or sell a work, buy a print, or accept an order as a printing, packaging or shipping partner on Artful Heart. Read them together with the marketplace disclaimer set out below.

1. Marketplace role

Artful Heart (“Artful Heart,” “we,” “us” or “our”) operates a marketplace and technology platform through which independent Sellers, Creators, Buyers and printing, packaging, shipping and other fulfilment partners may list, discover, purchase, produce, package and deliver physical creative works and related products (“Works”).

Artful Heart may act as the merchant of record for Orders placed through the Platform. This means that Artful Heart may collect payment from the Buyer, facilitate checkout, issue or arrange transaction documentation, process refunds, and pay eligible Sellers and Fulfilment Partners after applicable fees, deductions, verification, production, delivery, disputes, chargebacks and legal requirements.

Artful Heart’s merchant-of-record or payment role does not mean that Artful Heart created, authored, owns, independently verified, manufactured, printed, packaged, shipped or endorsed every Work. The relevant Seller, Creator or Fulfilment Partner remains responsible for the matters allocated to that person under the listing, Order, applicable policy, separate agreement or Applicable Law.

2. Accounts and sign-up

By creating an account you confirm that the information you provide is accurate, that you are legally able to enter into a contract, and that you will keep your credentials secure. You are responsible for activity carried out through your account.

One person or business should hold one account. Accounts, handles and verified badges may not be sold, shared or transferred without our written consent.

By signing up, submitting a Work, placing an Order or communicating through the Platform you accept these Terms, the marketplace disclaimer below, and our Privacy Policy, Returns and Refunds Policy, Seller Policy, Shipping Policy and Copyright Reporting Procedure.

We may suspend, restrict or close an account where we reasonably believe there has been fraud, infringement, abuse, repeated policy breach, unsafe conduct or a requirement under Applicable Law.

3. Buying on Artful Heart

Prices shown at checkout include the Creator’s price, printing, shipping and any platform fee applicable to your Order, together with any discount arising from an active membership. The amount confirmed at checkout is the amount payable.

Payment is collected at checkout and held by the platform until the Order completes. Fulfilment dates shown before checkout are estimates supplied by the Creator or Fulfilment Partner and may shift because of production, courier or availability conditions.

Where an Order is collected in person, handover is confirmed with a one-time code shared with you. Where an Order is delivered, the fulfiller records proof of delivery and you have a limited window, shown on the Order page, to raise a dispute before the Order closes.

Provenance certificates, edition details and exclusivity markings are generated from information supplied by the Creator. Colours, tones, paper texture and finish may differ reasonably from your screen because of device calibration, colour profiles, printing materials and production tolerances.

Refunds, replacements and cancellations follow the Returns and Refunds Policy and the status of the Order at the time of the request. Statutory consumer rights are not affected.

4. Selling as a Creator

You represent that you hold the rights, permissions, releases, licences and authority required for every Work you upload, list, reproduce, market and sell, including for any person, brand, property or third-party material depicted.

You are responsible for accurate titles, descriptions, edition and exclusivity claims, pricing, print-size limits, availability windows and turnaround estimates.

Uploads are screened for duplicates using file checksums and perceptual fingerprints, including region fingerprints that detect cropped copies. Close matches may be blocked or held for review. You may dispute a finding, in which case the Work stays as a draft until the review is complete.

Marking a Work as exclusive is permitted only before its first sale, and an exclusive Work is locked to a single sale once payment completes. Re-listing, duplicating or reproducing a sold exclusive Work elsewhere on the Platform is not permitted.

Earnings are credited to your settlement account after the Order completes and after platform fees, applicable taxes, refunds, chargebacks and any adjudicated dispute deductions.

5. Printing and shipping partners

By accepting an Order you agree to produce, package and dispatch it in the exact format, size, material and finish specified by the Buyer and shown on the Order, within the fulfilment window you confirm.

For Orders claimed from the open pool you must explicitly accept the fulfilment terms at the time of claiming, including where the requested format is not part of your own catalogue.

Where required, proof of printing and proof of delivery must be uploaded before an Order can move forward. These records are used to resolve Buyer complaints.

Where the platform adjudicates that an Order was not executed in the agreed format or size, printing and shipping amounts may be refunded to the Buyer and withheld from the fulfiller for that Order.

You are responsible for calibration and colour accuracy, safe packaging, courier handover timelines, tracking information, careful handling of Buyer addresses and contact details, and compliance with tax and other Applicable Law.

6. Payments, fees and memberships

Platform fees are shown before you commit to a transaction. Seller-side membership rates reduce the fee charged on your sales; buyer-side membership discounts reduce the fee applied to your purchases. Both may apply to the same Order only where both parties hold an active membership.

Membership benefits apply only within the active membership window. Changes to fees, tiers or benefits apply prospectively.

We may hold, delay or adjust a payout where an Order is disputed, where a chargeback or refund is pending, where verification is incomplete, or where required by Applicable Law.

7. Content, conduct and reporting

You may not upload, list or transmit material that is unlawful, infringing, counterfeit, deceptive, defamatory, harmful, or that misuses another person’s image, identity or personal information.

Report suspected infringement, plagiarism, fraud, illegal content, unsafe conduct, inaccurate listings, defective Works, delivery issues or payment issues through the applicable channel as soon as reasonably practicable.

A report should include the relevant listing or Order identifier, a description of the issue, dates, supporting evidence and the action requested. Rights holders should also provide information sufficient to identify the Work and the right allegedly violated, explain the basis of the complaint, provide contact details and confirm authority to submit the report.

We may investigate, request information, contact the affected parties, restrict or remove a listing, disable access to content, suspend an account, cancel an Order, hold or adjust a payout where permitted, process a refund, preserve records or refer the matter to a competent authority. We do not guarantee that a report will result in removal or in a particular remedy.

8. Third-party content and conduct

To the maximum extent permitted by Applicable Law, Artful Heart is not responsible for third-party content, listings, representations, acts or omissions of Sellers, Creators, Buyers, printers, carriers or other Fulfilment Partners. This includes claims or losses relating to a third party’s:

  • unlawful, fraudulent, negligent, defamatory, harmful or misleading act or omission;
  • lack of ownership, licence, consent, release or authority concerning a Work;
  • plagiarism, copying, counterfeit material, unauthorised derivative work or infringement of copyright, trademark, design, privacy, publicity or other rights;
  • inaccurate description, image, price, edition, condition, provenance, authenticity, availability or delivery representation;
  • defective, unsafe, damaged, delayed, lost, misprinted or incorrectly fulfilled Work;
  • breach of a contract, Order or Transaction obligation;
  • failure to comply with tax, consumer, intellectual-property, import, export, shipping or other Applicable Law; or
  • collection, disclosure or misuse of personal information.

The person whose act or omission caused the relevant issue remains primarily responsible for the resulting claim, subject to Applicable Law. Artful Heart may refer a complaint to the relevant Seller, Creator, Buyer or Fulfilment Partner and may request that person’s response, evidence, corrective action or cooperation.

9. No guarantee or endorsement

Artful Heart does not guarantee or independently certify the identity, ownership, originality, authenticity, legality, safety, quality, condition, durability, availability, fitness, merchantability, accuracy, production, packaging, delivery or performance of every Work, Seller, Creator or Fulfilment Partner.

Images, previews, colours, dimensions, materials, edition details, authentication statements and other listing information are supplied by or on behalf of the relevant Seller or Creator unless expressly stated otherwise. Reasonable differences may arise because of device screens, colour profiles, printing materials, production tolerances, editing, packaging and shipping conditions.

A listing, search result, recommendation, review, rating, badge, verification step or display position is not an endorsement, guarantee, certification or representation that the relevant Work or participant complies with all Applicable Law.

10. No blanket exclusion of our own obligations

These Terms do not exclude or limit liability arising from Artful Heart’s own fraud, wilful misconduct, negligence, breach of contract, payment or refund obligations, data-protection obligations, merchant-of-record functions, representations, failure to follow Applicable Law, or any liability that cannot lawfully be excluded or limited.

Nothing here removes or restricts a Buyer’s mandatory statutory rights, consumer remedies, regulatory remedies, rights of appeal or right to approach a competent court, tribunal, regulator or law-enforcement authority.

11. Cooperation with lawful orders

Artful Heart will cooperate with valid and legally binding orders, notices, requests and directions issued by courts, tribunals, regulators, law-enforcement authorities and other competent bodies.

Such cooperation may include preserving or disclosing records, identifying relevant accounts where legally permitted, restricting or disabling access to content, suspending accounts, cancelling or holding an Order or payout, processing a refund, assisting an investigation or taking another action required by Applicable Law.

We may request a formal order, notice, warrant, statutory request or other legally sufficient documentation where appropriate, and may seek clarification, challenge or narrow a request we reasonably believe is invalid, overbroad or inconsistent with Applicable Law. We may disclose information without prior notice where notice is prohibited, would prejudice an investigation, create a safety risk or undermine the purpose of the request.

12. Claims and indemnity

Artful Heart does not intend to be a party to disputes arising solely from the acts or omissions of a Seller, Creator, Buyer or Fulfilment Partner. Where a dispute concerns the Work or conduct of a particular participant, the affected parties should first pursue the matter against the primarily responsible participant through the applicable contractual, support, grievance, consumer, civil or criminal process.

Nothing here prevents a court, tribunal, regulator, law-enforcement authority, rights holder or other competent body from naming, joining, directing, investigating or requiring the participation of Artful Heart. Artful Heart may also bring or defend a claim, seek urgent injunctive relief, provide evidence, comply with an order or participate in a proceeding where it considers that necessary or where required by Applicable Law.

A Seller, Creator or Fulfilment Partner may be required to defend, indemnify and hold harmless Artful Heart and its owners, officers, employees, contractors, payment providers and service providers from claims, losses, liabilities, damages, penalties, costs and reasonable legal fees arising from that person’s own Work, content, listing, act, omission, Transaction, breach of Applicable Law or violation of a third-party right, subject to Applicable Law.

13. Acceptance

By using Artful Heart, browsing a listing, creating an account, submitting a Work, placing an Order or communicating through the Platform, you acknowledge that Artful Heart is a marketplace and technology platform, that third-party participants remain responsible for their own conduct and Works, and that these Terms must be read together with Artful Heart’s Privacy Policy, Returns and Refunds Policy, Seller Policy, Shipping Policy and Copyright Reporting Procedure.

We may update these Terms from time to time. Material changes take effect prospectively from the date shown at the top of this page.
